On May 23, 2013, Governor Kitzhaber announced a vacancy on the Multnomah County Circuit Court to fill the vacancy created by the resignation of Judge Michael J. McShane. Interest forms must be received by 5:00 p.m. on Monday, June 17, 2003.Details available here.

On May 7, 2013, Governor Kitzhaber announced a vacancy on the Columbia County Circuit Court to fill the vacancy created by the resignation of Judge Steven B. Reed. Twelve candidates have submitted information for appointment.Details available here.

On March 5, 2013, Governor Kitzhaber announced the appointment of Matthew J. Donohue to the Benton County Circuit Court to fill the seat vacated by Judge Janet Schoenhard Holcomb. Details available here.

On April 17, 2013, Governor Kitzhaber announced the appointment of Heather L. Karabeika to fill the vacancy on the Clackamas County Circuit Court created by the retirement of Judge Steven L. Maurer. Details available here.

On March 6, 2013, Governor Kitzhaber announced the appointment of Robert F. Nichols, Jr. to the Lake County Circuit Court to fill the seat vacated by Judge Lane W. Simpson. Details available here.

On March 13, 2013, Governor Kitzhaber announced the appointment of David E. Delsman to the Linn County Circuit Court to fill the vacancy created by the resignation of Judge James C. Egan. Details available here.

On January 17, 2013, Governor Kitzhaber announced the appointments of Beth Allen and Amy Holmes Hehn on the Multnomah County Circuit Court to fill the seats created by the retirement of Judge Michael H. Marcus and the election of Judge Richard Baldwin to the Oregon Supreme Court. Details available here.

Governor Kitzhaber Extends Application Deadline for New Oregon Court of Appeals Positions


(Salem, OR) — Governor Kitzhaber announced today that he is extending the deadline to submit an application for the three new positions on the Oregon Court of Appeals created by the passage of HB 4026 during the 2012 legislative session. The new positions take effect October 1, 2013, and are contingent on the legislatively approved budget for the 2013-15 biennium. The new deadline to submit a completed application is July 1, 2013.

Anyone interested in applying should submit an Appellate Judicial Interest Form to the Governor’s office. Please note that this form is specifically for appellate appointments and not the form used for circuit court appointments. Interested applicants should mail or deliver the forms to: Liani J. Reeves, General Counsel, Office of the Governor, 900 Court Street NE, Salem, OR 79301-4047. Forms must be received by 5:00 p.m. on Monday, July 1, 2013. The form may be faxed or e-mailed by 5:00 p.m. on the closing date to be considered received as long as the original signed form is also postmarked by the closing date.

Governor Kitzhaber fills judicial vacancies based on merit.  He encourages applications from lawyers with a wide variety of backgrounds and experiences.
 
ORS 2.540 provides that a judge of the Court of Appeals shall be an elector of the county of residence of the judge and be admitted to the practice of law in the state.

The Appellate Selection Committee of the Oregon State Bar Board of Governors will conduct a due diligence/review process with an in-depth review of each application and candidate. The Committee's review is intended to provide the Governor with relevant, reliable and descriptive information to better inform his appointment decision. Upon completion of its review of the candidates, the Committee will submit a background summary of all the candidates to the Board of Governors. The board will then determine the final list of candidates to submit to the Governor.

Governor Kitzhaber Announces Multnomah Circuit Court Vacancy


Judge McShane confirmed by the United States Senate for a seat on the United States District Court


Governor Kitzhaber is accepting applications for the judicial position on the Multnomah County Circuit Court to fill the seat vacated by Judge Michael J. McShane. A press release was issued by the Governor's Office on Thursday, May 23, and contained the following information:

(Salem, OR) — Governor Kitzhaber announced today that he is accepting applications for a judicial position on the Multnomah County Circuit Court to fill the vacancy created by the resignation of Judge Michael J. McShane. The Governor congratulated Judge McShane on his confirmation to the U.S. District Court for the District of Oregon and said he will fill the position by appointment. Judge McShane's resignation takes effect May 29, 2013.
 
Anyone interested in filling the position must submit an Interest Form for Judicial Appointments to the Governor's office. Because the form has been recently updated, all applicants must fill out a new judicial interest form. Interested applicants should mail or deliver the forms to: Liani J. Reeves, General Counsel, Office of the Governor, 900 Court Street NE, Salem, OR 97301-4047. Forms must be received by 5:00 p.m. on Monday, June 17, 2013. The form may be faxed or e-mailed by 5:00 p.m. on the closing date to be considered received as long as the original signed form is postmarked by the closing date.
 
Interested applicants who submitted a completed application in 2013 may rely on their earlier submission if they send a new cover letter that attests that the information in the previously submitted application is accurate and complete. The new cover letter and any updated information must be received by the deadline listed above.

ORS 3.041 and 3.050 provide that at the time of appointment to the court, the candidate must be a citizen of the United States, a resident of Oregon and a member of the Oregon State Bar.  ORS 3.041(2) further states: “[e]ach judge of the circuit court shall be a resident of or have a principal office in the judicial district for which the judge is elected or appointed, except that in any judicial district having a population of 500,000 or more, according to the latest federal decennial census, any judge of the circuit court may reside within 10 miles of the boundary of the judicial district.” Multnomah County has a population in excess of 500,000. ORS 3.041(5) provides the required length of time for the residency requirements.

Governor Kitzhaber Announces Columbia County Circuit Court Vacancy


Judge Reed to Retire from Columbia County Circuit Court


Governor Kitzhaber is accepting applications for the judicial position on the Columbia County Circuit Court to fill the seat vacated by Judge Steve B. Reed. A press release was issued by the Governor's Office on Tuesday, May 7, and contained the following information:

(Salem, OR) — Governor Kitzhaber announced today that he is accepting applications for a judicial position on the Circuit Court for Columbia County to fill the vacancy created by the retirement of Judge Steven B. Reed. The Governor thanked Judge Reed for his service to Columbia County and said he will fill the position by appointment. Judge Reed's retirement takes effect May 31, 2013.
 
Anyone interested in filling the position must submit an Interest Form for Judicial Appointments to the Governor's office. Because the form has been recently updated, all applicants must fill out a new judicial interest form. Interested applicants should mail or deliver the forms to: Liani J. Governor Kitzhaber Announces Appointment of Matthew J. Donohue to the Benton County Circuit Court



(Amsterdam, Netherlands) — Governor Kitzhaber today announced the appointment of Matthew J. Donohue to fill the vacancy on the Benton County Circuit Court created by the retirement of Judge Janet Schoenhard Holcomb.

"Matt Donohue is a committed public servant familiar with issues impacting both the local community and statewide as a member of the Corvallis 509J school board and as an attorney who litigates in trial courts around the state," said Governor Kitzhaber. "He also has a deep appreciation of the role that courts and the justice system play in the lives in the community and will be an advocate for increasing access to the courts for all the people of Benton County."

Mr. Donohue graduated from Oregon State University with a Bachelor of Science in Natural Resource Management and a Doctor of Jurisprudence from University of Oregon School of Law. After serving as a law clerk for the Honorable Rives Kistler on the Oregon Court of Appeals and the Oregon Supreme Court, Mr. Donohue joined the Oregon Department of Justice as an Assistant Attorney General (AAG) in the Trial Division. As an AAG, Mr. Donohue has handled civil litigation matters throughout the state, including defense of state agency orders and condemnation cases.

A dedicated member of the community, Mr. Donohue has twice been elected to the Corvallis 509J School Board and serves as a volunteer with the Marion County Teen Court.




Governor Kitzhaber Appoints Heather L. Karabeika to the Clackamas County Circuit Court


(Salem, OR) — Governor Kitzhaber today announced the appointment of Heather L. Karabeika to fill the vacancy on the Clackamas County Circuit Court created by the retirement of Judge Steven L. Maurer.

"Heather Karabeika has a reputation as a skilled, fair and reasonable lawyer," said Governor Kitzhaber of the appointment. "She has already successfully demonstrated her ability to transition from an advocate to a neutral position as a municipal judge. She will be able to hit the ground running and continue her service to the people of Clackamas County as a judge on the Circuit Court."

Ms. Karabeika graduated from Washington State University with a Bachelor of Arts in Criminal Justice and a Doctor of Jurisprudence from Willamette University School of Law. Ms. Karabeika has extensive trial experience, serving as both a deputy district attorney and indigent defense attorney in Clackamas County. She also has experience in civil litigation and domestic relations. She was appointed by the City Council of West Linn to serve as the municipal court judge and was then elected by voters to fill the position in 2008 and 2010.

Ms. Karabeika is a member of the Clackamas County Bar Association and Oregon Women Lawyers, and she participates in local school activities such as the West Linn High School Mock Trial Program and Athey Creek Middle School Science Mock Trial Project.




Governor Kitzhaber Announces Appointment of Robert F. Nichols, Jr. to the Lake County Circuit Court


(Berlin, Germany) — Governor Kitzhaber today announced the appointment of Robert F. Nichols, Jr. to fill the vacancy on the Lake County Circuit Court created by the retirement of Judge Lane W. Simpson.

"Mr. Nichols brings extremely diverse practice experience to the Lake County Circuit Court including experience with civil litigation, domestic relations, business law and both criminal prosecution and defense, making for a smooth transition for the circuit court," said Governor Kitzhaber. "More importantly, Mr. Nichols brings a longstanding commitment to the community and the people of Lake County."

Currently a shareholder in the general law practice of Bogardus & Nichols, P.C., Mr. Nichols has been practicing law in Lake County for 34 years. This includes serving eight years as the Lake County District Attorney and as the Lake County Counsel, as well as representing the Lake County School District #7 and the Town of Paisley. A Lakeview High School graduate, Mr. Nichols received his Bachelor of Science in Business Administration from Oregon State University and his Doctor of Jurisprudence from Willamette University College of Law.

Mr. Nichols has been an active member of the community including serving on the Lake County Chamber of Commerce and as a 20-year member of the Warner Canyon Ski Patrol.




Governor Kitzhaber Announces Appointment of David E. Delsman to the Linn County Circuit Court


(Salem, OR) — Governor Kitzhaber today announced the appointment of David E. Delsman to fill the vacancy on the Linn County Circuit Court created by the recent election of Judge James C. Egan to the Oregon Court of Appeals.

"Dave Delsman has broad experience in criminal and civil litigation and brings a demonstrated commitment to ensuring access to justice for all," said Governor Kitzhaber. "I am confident that he will serve the citizens of Linn County and the State of Oregon with distinction."

Mr. Delsman received both his Bachelor of Science in political science and his Doctor of Jurisprudence from the University of Oregon. After graduating with his law degree, Mr. Delsman opened a solo practice in Albany, where he became a seasoned criminal and civil litigator with a reputation for being professional and remaining even-tempered under pressure.

A former chairman of St. Mary's School Advisory Committee, Mr. Delsman volunteers with the Classroom Law Project and serves as the regional coordinator for the West Albany Mock Trial Program. He also has served on the Linn County Court Security Advisory Committee and was a board member of the Linn County Victim Offender and Reconciliation and Mediation Services.




Governor Kitzhaber Announces Appointments of Beth Allen and Amy Holmes Hehn to Multnomah County Circuit Court



(Salem, OR) – Governor Kitzhaber today announced the appointments of Beth A. Allen and Amy Holmes Hehn to fill the vacancies on the Multnomah County Circuit Court created by the retirement of Judge Michael H. Marcus and the election of Judge Richard Baldwin to the Oregon Supreme Court. The court previously indicated that the appointees will be assigned to the Family Law Department.

Ms. Allen, a veteran of the United States Army, received a Bachelor of Science from Portland State University and a Doctor of Jurisprudence from Willamette University College of Law. Ms. Allen has had her own law practice since 2006, where she developed a specialized practice dealing with family law and related issues impacting the LGBT community. She also has experience in a wide area of civil law including employment and accommodation law, estate planning and general business law. Ms. Allen has been a tireless advocate for diversity and access to justice issues and has received numerous awards, including the Oregon Gay and Lesbian Law Association's Special Merit Award. Ms. Allen has served in many volunteer roles including on the Board of Directors of the Q Center and as a volunteer with the Multnomah Bar Association High School Dropout Prevention Program.

Ms. Holmes Hehn received a Bachelor of Science from Willamette University and a Doctor of Jurisprudence from Suffolk University College of Law. Ms. Holmes Hehn has served as a prosecutor in the Multnomah County District Attorney's Office for 25 years, most recently as the head of the Domestic Violence Unit. She previously served as the head of the Juvenile Unit and has served on the Office's Multidisciplinary Child Abuse Team. Ms. Holmes Hehn has dedicated her personal and professional life to the service of children and families. She has extensive community service working with various task forces and organizations including the Multnomah County Family Violence Coordinating Council and the Oregon Law Commission Juvenile Code Revision Work Group.

"Ms. Allen's domestic relations and civil experience and Ms. Holmes Hehn's experience as a juvenile and domestic violence prosecutor will bring over 40 years of expertise to the Multnomah County Circuit Court," said Governor Kitzhaber. "But more important than their substantive experience, Ms. Allen and Ms. Holmes Hehn bring a keen understanding of the critical role that judges in Oregon's family courts play in the community and an unwavering commitment to improving the lives of Oregon's children and families."




Governor Kitzhaber Appoints Gregory F. Silver to the Multnomah County Circuit Court



(Salem, OR) — Governor Kitzhaber today announced the appointment of Gregory F. Silver to fill the vacancy on the Multnomah County Circuit Court created by the retirement of Judge Janice R. Wilson.

“Greg Silver has already proven himself to be a competent and dedicated judge,” said Governor Kitzhaber. “As a lawyer and a pro tem, he has demonstrated not only that he has the legal ability and temperament to be a judge but also that he understands the impact a judge has on the lives of people who come before the court. Appointing him as a circuit court judge will allow him to continue to serve the public in positive ways.”

Mr. Silver graduated from Penn State University with a Bachelor of Arts in Speech and a Doctor of Jurisprudence from the University of Pittsburgh School of Law. Mr. Silver has been serving in a judicial capacity as a Circuit Court Judge Pro Tem/Hearings Referee in Multnomah County for the past six years. Prior to serving as a pro tem judge, he worked at the Metropolitan Public Defender Services and taught as an adjunct professor at Lewis & Clark Law School. He also worked as a civil litigator handling complex corporate and environmental cases at a private law firm in Pittsburgh before locating to Oregon.

Mr. Silver is very involved in the legal community and law reform efforts including serving on the OSB uniform Criminal Jury Instructions Committee, on Multnomah Bar Association committees and on the steering committee on the formation and implementation of the Multnomah County Domestic Violence Court.
